1. General provisions
1.1. Sole proprietor Ihor Kostiantynovych Kocherha (taxpayer number 3490413098), the "Provider", offers any legally capable individual aged 18 or over, as well as any legal entity or sole proprietor, the "Client", to conclude a services agreement on the terms of this public offer, the "Agreement".
1.2. The Agreement is a public agreement and an agreement of adhesion under Articles 633, 634, 641 and 642 of the Civil Code of Ukraine. Its terms are the same for all Clients.
1.3. The Agreement is published on https://americanizationusa.com, operated under the name "Americanization", the "Website" (including all of its pages). The current version of the Agreement is always available at https://americanizationusa.com/offer. The Privacy Policy (https://americanizationusa.com/privacy) forms an integral part of the Agreement.
1.4. The Agreement is published in Ukrainian, Russian and English. If the versions differ, the Ukrainian version prevails.
1.5. Definitions: "Services" means the information, consulting, organizational and technical services described in Section 3; "Government Authorities" means USCIS, the US Department of State, US embassies and consulates and other government bodies of any country; "Government Fees" means consular, registration and other fees payable to Government Authorities.
2. Important disclaimers
2.1. The Provider is not an attorney, a law firm or an accredited representative and is not authorized to provide legal services or to represent the Client before Government Authorities. The Services are not legal advice and do not replace it.
2.2. The Provider is not affiliated with the US government, USCIS, the US Department of State or any other Government Authority and does not act on their behalf.
2.3. Decisions on visas, statuses, permits, the Green Card lottery and other applications are made solely by Government Authorities. The Provider does not guarantee any outcome, including visa issuance, approval of an application, winning the lottery or processing times.
2.4. Official registration for the Green Card (DV) lottery takes place at dvprogram.state.gov on the terms set by the US Department of State. Payment under this Agreement is payment for the Provider's assistance, not a fee for entering the lottery.
2.5. Technical assistance with forms is provided solely on the basis of the Client's information and instructions. The Provider does not choose an immigration strategy for the Client and does not assess the legal consequences of the information the Client submits.
3. Subject of the Agreement
3.1. For a fee, the Provider renders Services to the Client within the scope of the selected package or agreed order, including:
- information consultations on visa and immigration procedures based on open official sources;
- support in preparing for a B1/B2 tourist visa: checking that documents are complete, filling out the DS-160 with the Client's information, help creating an online account, booking an interview and paying the consular fee, and interview preparation;
- technical assistance filling out USCIS forms (including I-821, I-765, I-131 and AR-11) with the Client's information;
- technical registration for the Green Card (DV) lottery with the Client's information and photos;
- translation, organizational help choosing flights and housing, and other services described on the Website.
3.2. The specific list, price and timing of the Services are defined by the description on the Website and/or by the Parties' correspondence before payment.
4. Conclusion of the Agreement
4.1. Acceptance of the Agreement is any of the following actions by the Client: paying for the Services; ticking the box on the Website confirming that the Client has read the Agreement; or confirming agreement in writing by email or messenger.
4.2. By accepting, the Client confirms that they are 18 or older, have read and understood the Agreement and the Privacy Policy, and accept them in full and without reservation.
4.3. The Agreement is concluded in electronic (written) form under Articles 205 and 207 of the Civil Code of Ukraine and the Law of Ukraine "On Electronic Commerce". The Parties accept correspondence by email and messenger as valid evidence.
5. Price and payment
5.1. The price of the Services is stated on the Website or agreed individually in writing (email, messenger) before payment. The amount agreed before payment is final and is not revised after payment.
5.2. Unless the Parties agree otherwise, payment is made 100% in advance through Plata by Mono (Universal Bank JSC), to the Provider's account at Universal Bank JSC, or by another official method stated in the Provider's invoice. A payment to any other details is not payment to the Provider.
5.3. Government Fees are not included in the price of the Services, are paid by the Client separately and are not refunded by the Provider.
5.4. Bank, payment system and currency conversion fees are paid by the Client.
5.5. The Provider may change prices on the Website. New prices do not apply to orders already paid. Promotional prices apply only during the stated period.
6. Delivery of the Services
6.1. The Provider begins delivering the Services after payment and after receiving the necessary information and documents from the Client.
6.2. Delivery times depend on the Client providing information on time. Any delay on the Client's side extends the Provider's deadlines accordingly.
6.3. The Client must review prepared forms and applications before signing and submitting them. Signing or submitting a form, or authorizing the Provider to submit it technically, means the Client has confirmed that the information is correct.
6.4. A Service is deemed delivered: a consultation, from the moment it begins; completion of a form or application, from the moment the completed document is handed to the Client or submitted; lottery registration, from receipt of the confirmation number; interview booking, from receipt of the appointment confirmation; a service package, once all actions that depend on the Provider are completed.
6.5. Delivery of the Services is evidenced by correspondence, files sent, confirmations from government systems, consultation recordings and the fact of payment. A completion certificate is issued at the Client's request. If the Client sends no written, reasoned objections within 5 days after a Service is delivered, the Service is deemed accepted.
6.6. The Provider may engage assistants and subcontractors and is responsible for their actions as for its own. Only the Provider is liable to the Client.
7. Rights and obligations of the Parties
7.1. The Client must:
- provide truthful, complete and current information and documents and report any changes;
- keep track of the expiry of their own status and documents and of deadlines set by Government Authorities, and inform the Provider of them in advance;

- keep access to their online accounts secure and change passwords after the Services are completed;

7.2. The Client warrants that they have the consent of every person (including family members) whose data they pass to the Provider, and that they are the legal representative of any minors concerned.
7.3. The Client is fully responsible for the consequences of providing false, incomplete or outdated information, including refusal, cancellation of an application or a bar on entry.

8. Withdrawal and refunds
8.1. The Client may withdraw from the Agreement at any time by sending written notice to the Provider's email.
8.2. If delivery of the Services has not started, the Provider refunds the payment less bank fees.
8.3. If delivery has started, only the price of the part not actually delivered is refunded, less the price of Services already delivered and expenses incurred by the Provider. The price of the delivered part is calculated in proportion to the work performed.
8.4. The following are non-refundable: payment for a consultation held or begun; payment for lottery registration once submitted; payment for a form completed and handed to the Client; Government Fees; payment where the Service was not delivered through the Client's fault (including failure to provide information for more than 30 days, false information or refusal to cooperate).
8.5. A refusal by a Government Authority, the lottery result or processing times are not grounds for a refund.
8.6. Refunds are made within 14 days after the amount is agreed, by the same method used for payment.
8.7. Quality claims are accepted in writing within 14 days after the Service is delivered. If a defect is the Provider's fault, the Provider fixes it free of charge (corrects the form or holds an additional consultation) or, if it cannot be fixed, refunds the price of the relevant part of the Services.
9. Liability
9.1. The Provider is not liable for:
- decisions, actions, inaction and processing times of Government Authorities, or changes in laws and rules;
- outages of Government Authority, bank or payment system websites;
- the consequences of false, incomplete or late information from the Client;
- decisions and actions the Client takes based on the information received;
- actions of third parties, including carriers, landlords, banks and messengers.
9.2. The Provider's total liability under the Agreement is limited to the amount actually paid by the Client for the relevant Service. The Provider does not compensate lost profits or indirect losses, except where such liability is expressly required by mandatory law.
9.3. The limitations in this Section do not apply to an intentional breach of the Agreement.
10. Confidentiality and intellectual property
10.1. The Parties keep confidential the information received while performing the Agreement. Personal data is processed in accordance with the Privacy Policy.
10.2. The Client may record a consultation only with the Provider's prior consent. The Provider's materials are for the Client's personal use; distributing them without the Provider's consent is prohibited.
11. Payment disputes
11.1. Before disputing a payment through a bank (chargeback), the Client must send the Provider a written claim and allow 14 days for a reply.
11.2. If a payment is disputed without grounds, the Provider may provide the bank with evidence that the Services were delivered and claim compensation from the Client for the resulting losses, including fees and expenses.
12. Force majeure
12.1. The Parties are released from liability for failure to perform due to force majeure, including martial law and hostilities, terrorist acts, natural disasters, epidemics, decisions of authorities (including suspension of embassy operations, application intake or programs), blocking of payment systems, sanctions, and prolonged power, internet or communication outages.
12.2. A Party relying on force majeure notifies the other Party within 7 days. Deadlines are extended for the duration of such circumstances. If they last more than 60 days, either Party may withdraw from the Agreement, with settlement under clause 8.3.
13. Dispute resolution
13.1. Disputes are resolved through negotiation. A claim is sent to the Provider's email; the response period is 14 days.
13.2. The Agreement is governed by the law of Ukraine. Disputes are heard by the courts of Ukraine, unless mandatory consumer protection law applicable to the Client provides otherwise.
14. Term and other provisions
14.1. The Agreement is in force from acceptance until all obligations are fulfilled.
14.2. The Provider may amend the Agreement. A new version takes effect when published on the Website and does not apply to orders paid earlier.
