TPS for Ukrainians after October 19, 2026: what USCIS said, EAD and what to do now

Everything known about TPS (Temporary Protected Status) for Ukrainians as of 10/25/2026: what USCIS said on October 19, what lawyers say, what it means for work authorization and your employer, and what to do now.

🗓 Updated October 26, 2026❓ 23 answers✍️ Written by Nataliia · reviewed by Ihor Kocherha⚠️ 10/19/2026 USCIS: Ukrainians with TPS retain protection and work authorization until a further announcement. As of 10/25/2026 there is no DHS decision in the Federal Register

⚡ In short

  • ✅ Is Ukraine TPS extended? As of 10/25/2026 there is no official DHS extension notice, but USCIS confirmed protection and work authorization continue until a further announcement. By law TPS extends automatically for 6 months; attorneys count to 04/19/2027.
  • On 10/19/2026 USCIS updated its Ukraine TPS page: until a further announcement, Ukrainians with TPS "retain protection, including work authorization".
  • As of 10/25/2026 there is no DHS decision (extension or termination) in the Federal Register. USCIS has not said how long the protection lasts.
  • Under the law (INA §244(b)(3)(C)), if DHS does not decide at least 60 days before the end date, TPS is automatically extended for 6 months. Lawyers count: through 04/19/2027. This date has not been officially confirmed.
  • There is no new EAD date for A12/C19 and no new I-9 instructions: the employer instructions of 09/03/2026 with the date "Oct. 19, 2026" still apply. Lawyers advise not to treat that date alone as proof that work authorization is invalid.
  • Since 10/16/2026 new fees apply: I-821 (H.R.1 fee) $520, initial TPS EAD $570 (H.R.1 fee). EAD renewal: $280 (H.R.1 fee), unchanged.
  • Bills H.R. 10740 and S. 5490 on TPS for Ukrainians have only been referred to committees.

📅 What is known as of 10/25/2026

Here are only verified facts and clearly labeled lawyers' opinions. The situation can change any day: check the USCIS page on TPS for Ukraine.

❓When does TPS for Ukraine end, and was it extended after October 19, 2026?+

There is no official extension in the Federal Register, but no termination either: on 10/19/2026 USCIS said that until a further announcement, Ukrainians with TPS retain protection, including work authorization.

The text on the USCIS page: "An announcement on Ukraine's TPS will be made at the appropriate time. Until such announcement is made, Ukrainian individuals present in the U.S. under TPS retain protection including work authorization." The page still says "TPS Designated Through: Oct. 19, 2026" and gives no end date for the protection. Lawyers believe TPS has already been extended by law through 04/19/2027 (see the next question). A final DHS decision may come any day, so rely only on uscis.gov and the Federal Register.

⚖️What is the automatic TPS extension by law, and why do people say April 19, 2027?+

It is a rule in the law: if DHS does not decide the fate of TPS on time, the status extends itself for 6 months. The law (INA §244(b)(3)(A), (C)) requires DHS to make and publish a decision at least 60 days before the end date. For Ukraine that was 08/20/2026. Nothing was published.

  • Lawyers' position (Ukraine Immigration Task Force, Lux Law, Polaris, Immigration Analytics, and others): TPS has been extended "by operation of law" through 04/19/2027.
  • USCIS position: the 04/19/2027 date has not been officially named. Since 10/19/2026 USCIS only says that protection and work authorization continue until an announcement made "at the appropriate time".
  • Lawyers also believe that even if TPS is terminated, the termination cannot take effect earlier than 60 days after publication, and not before the end of the current period.

So the argument is strong, but it is an interpretation, not an official document.

🇸🇻What happened on October 19, and is it like El Salvador?+

Yes, it repeats the El Salvador scenario: the date passed without a DHS decision, and USCIS posted a short notice that protection continues.

TPS for El Salvador ended on 09/09/2026, also without a decision. USCIS then wrote that an announcement would be made "at the appropriate time" and that until then people "retain protection, including work authorization". On 10/19/2026 the same text appeared on the TPS page for Ukraine (and for Sudan). USCIS gave no end date for the protection, and as of 10/25/2026 there are no new I-9 or E-Verify instructions. A final decision may come at any moment, so keep checking official sources.

📰I read that Trump decided to extend TPS for Ukrainians. Is it true?+

There is no official confirmation. On 10/02/2026 Radio Liberty, citing two anonymous sources, reported a "preliminary decision" to extend TPS. No duration or conditions were given.

As of 10/25/2026 nothing has appeared in the Federal Register. On 10/19/2026 USCIS only confirmed that protection and work authorization continue until a further announcement. According to Politico (10/08/2026), the options discussed included exactly this "quiet" 6-month automatic extension. So rely only on official publications, not headlines.

🏛️Can TPS for Ukraine be terminated after the Supreme Court decision on Syria and Haiti?+

In theory, yes; the risk is real. On 06/25/2026, the Supreme Court in Mullin v. Doe allowed the termination of TPS for Syria and Haiti and limited court review of such decisions. This means DHS has broad powers.

What holds it back: the law requires a termination to take effect no earlier than 60 days after publication. On 09/22/2026, 31 senators from both parties asked for TPS for Ukraine to be extended and redesignated for 18 months. As of 10/25/2026 there is no termination decision. If your status depends only on TPS, discuss a backup plan with a licensed immigration attorney now.

📜What are bills H.R. 10740 and S. 5490, and when will they pass?+

These are bills that would secure TPS for Ukrainians in law. For now they are only in committee, and nobody promises quick passage.

  • H.R. 10740 was introduced by Keating (D-MA) on 10/05/2026. 47 cosponsors, 8 of them Republicans. Referred to the House Judiciary Committee.
  • S. 5490 is the identical bill in the Senate, introduced by Blumenthal on 09/23/2026, cosponsors Murkowski, Coons, Cassidy.
  • According to law firms and the press, they propose TPS until about 2029, processing applications within 90 days, and protection from unlawful presence. The final text may change.

According to public records, there has been no action other than referral to committee. A separate Ukrainian Adjustment Act (H.R. 3104, green card) has been sitting in committee since 04/30/2025.

💼 Work permit (EAD) and your employer

🧾My TPS EAD (A12/C19) expired on October 19. What do I show my employer?+

There is no new EAD date, so show what you have: your EAD card, the USCIS extension letter through 10/19/2026 and a printout of the USCIS notice of 10/19/2026 saying protection and work authorization continue.

  • The latest official I-9 and E-Verify instructions are from 09/03/2026 and use the date "Oct. 19, 2026". As of 10/25/2026 there are no new instructions, and the old ones have not been withdrawn.
  • Employer-side lawyers (for example, Greenberg Traurig, 10/21/2026) advise not to treat the 10/19/2026 date alone as proof that authorization is invalid and not to make hasty decisions.
  • Ask HR to watch the USCIS page and I-9 Central: a new notice can be applied right away.

If you are still taken off work, get a letter from your employer: it is evidence for an expedite request.

⏳Will my EAD be automatically extended for 540 days if I filed for renewal?+

No. The automatic 540-day extension was eliminated for EAD renewal applications filed on or after 10/30/2025. On 10/14/2026 this was made permanent by a final DHS rule (91 FR 65306).

This rule does not directly affect TPS EAD extensions granted by law or by a Federal Register notice. For Ukrainian TPS the last such extension ran through 10/19/2026; since then USCIS has only said that work authorization continues until an announcement. Separately: under H.R.1, a new TPS EAD is issued for no longer than 1 year or until TPS ends, whichever comes first.

🔤What is the difference between EAD A12 and C19?+

A12 is a work permit for a person who has already been granted TPS; C19 is for someone whose TPS application is still pending but whom USCIS has found prima facie (at first glance) eligible.

For renewals, USCIS allows the category on the old card and on the new I-765 to differ: you can have C19 and apply for renewal as A12. Both categories are covered by the USCIS notices extending EADs through 10/19/2026, if the I-765 is pending and TPS has not been terminated.

🚫Can I work if my EAD has already expired and the renewal is still pending?+

No, you cannot work without valid work authorization. For Ukrainian TPS, since 10/19/2026 USCIS says work authorization continues until a further announcement, but it has not given a new EAD date.

Working without authorization is a status violation that can hurt a future green card. If your employer takes you off work because of the date on your card, do not work "unofficially". What you can do: show the USCIS notice of 10/19/2026, submit an expedite request because you are at risk of losing your job, contact your congressperson, keep the letter from your employer. Americanization can help prepare an expedite request.

If your employer fires you because of the date on your document, consult an employment lawyer: an employer has no right to demand a specific document from List A.

⏱️ Pending application

🛡️Am I in the US legally if I filed for TPS but it is not approved yet?+

You are partly protected: if USCIS found you prima facie eligible, you cannot be deported while the application is pending.

  • The law (INA §244(a)(4)(B)) gives this temporary protection until a final decision, and USCIS writes that such applicants "are not removable".
  • The law guarantees protection from detention based on immigration status specifically to those who have been granted TPS.
  • The receipt itself (I-797C) is not an approval and not a work permit.

If you also have valid parole, you are in the US legally on parole. If your parole has expired and TPS is not yet approved, the situation is more complicated. For questions about unlawful presence accruing in your case, contact a licensed immigration attorney.

🐢My TPS has been pending for more than a year. What should I do?+

Unfortunately, this is a common situation: according to lawyers, re-registration takes about 13 months on average, and initial applications take 10–18 months.

  1. Check your status in myUSCIS and on the USCIS Processing Times page.
  2. If the processing time has been exceeded, submit a service request through the USCIS Contact Center.
  3. If you have a reason (job loss, medical treatment, financial loss), submit an expedite request with evidence.
  4. Contact your congressperson (casework) or the CIS Ombudsman.

You do not need to file the same application again: it only adds costs and confusion.

📭I did not get a TPS receipt. What should I do?+

First check whether the application was accepted: with online filing the receipt appears in your myUSCIS account right away, and with paper filing it comes by mail.

  • Check your bank statement: if the fee was charged, the application was accepted, and the receipt number is often visible on the back of the check or in the payment description.
  • If the package was returned, it was most often because of the wrong fee amount or a missing signature. From 10/16/2026, the old amount = rejection.
  • If the money was charged but there has been no receipt for a long time, contact the USCIS Contact Center and check that USCIS has your correct address (change of address: AR-11 within 10 days of moving).
✏️I made a mistake on my TPS form and already sent it. How do I fix it?+

It depends on the mistake: a typo can be fixed later, but a significant error is better discussed with a professional before you send anything.

  • Small mistakes (a typo, an address) are often fixed through the USCIS Contact Center or in response to a Request for Evidence (RFE).
  • Do not file a second I-821 "on top of" the first one without advice: two applications can confuse your case.
  • If the mistake concerns entry dates, citizenship, or criminal history, contact a licensed immigration attorney or an accredited representative (DOJ-accredited).

Keep a copy of the filed form: you will need it for all future applications.

📝 Re-registration, new applications, children, and fees

🔄Can I re-register (renew) TPS online right now?+

There is no open re-registration window right now: the last one ran from 01/17/2025 to 03/18/2025.

A new window will open only when DHS publishes an extension of TPS for Ukraine in the Federal Register. The notice will then state the deadlines (usually 60 days) and rules. You must re-register in every window, or you may lose TPS. You can file the I-821 online through your myUSCIS account, together with an I-765 if you need a new EAD.

If a window opens, Americanization can help with the technical side of filling out the forms.

⌛What if I missed TPS re-registration?+

Late re-registration is possible if you have good cause, which you explain in a letter with your application.

USCIS says directly that missing re-registration without good cause can cost you your TPS eligibility. Good cause may be, for example, illness, hospitalization, or other circumstances outside your control, supported by documents. The officer makes the decision. File as soon as possible and add an explanation with evidence. If the delay was long, consult an attorney.

🆕Can I apply for TPS for the first time if I arrived after August 16, 2023?+

No, not under the current designation. TPS for Ukraine is available to those who have continuously resided in the US since 08/16/2023 and have been physically present since 10/20/2023.

An automatic extension does not add new people: that requires a redesignation with new dates. Senators asked for a redesignation, but as of 10/25/2026 there is none. So for those who arrived later, other paths remain (parole, family or employment grounds, asylum), and they are worth discussing with a lawyer.

🔀I have re-parole (U4U). Should I also apply for TPS?+

If you meet the dates (in the US since 08/16/2023, present since 10/20/2023), many people apply for TPS as a second "backup" status, especially when re-parole has not been approved yet.

  • Late initial filing is allowed, among others, for people who were parolees or had a pending re-parole application; USCIS says so.
  • Downsides: fees ($520 H.R.1 fee for the I-821 from 10/16/2026, plus the EAD) and the fact that there is still no final decision on TPS after 10/19/2026.
  • Upside: TPS and parole are separate grounds; if one disappears, the other may remain.

On the form, honestly state your current status (parole) and dates. What is better in your case, considering costs and green card plans, is something to discuss with a professional.

👧How do I apply for TPS for children? Do children get TPS together with their parents?+

No, TPS is not passed on "automatically": each child files their own I-821. USCIS says directly: "You cannot obtain TPS as a derivative".

  • The child must meet the requirements on their own: Ukrainian citizenship, residence since 08/16/2023, presence since 10/20/2023.
  • A late initial filing is possible for the child of a person eligible for TPS if, during the initial registration period, the child was unmarried and under 21.
  • A child born in the US is a US citizen and does not need TPS.

Family members without Ukrainian citizenship (for example, with another passport) are not eligible under Ukrainian TPS.

💵How much does TPS cost from October 16, 2026?+

For applications postmarked on or after 10/16/2026, the new H.R.1 fees apply, and an application with the wrong amount will be rejected.

  • I-821, H.R.1 TPS fee: $520 (was $510).
  • I-765, first TPS EAD: H.R.1 fee $570 (was $560) plus the base I-765 fee ($470 online / $520 by mail).
  • I-765, TPS EAD renewal: H.R.1 fee $280, unchanged, plus the base fee.
  • Separately, the I-821 has a $30 biometrics fee (per G-1055).

H.R.1 fees cannot be waived with I-912. Whether the $520 is also charged for re-registration has not been officially clarified; check G-1055 before paying.

🧭 Outlook and what to do now

🟩Does TPS lead to a green card?+

No, TPS by itself does not lead to a green card: USCIS writes that it "does not lead to lawful permanent resident status".

But TPS does not prevent you from getting a green card another way: through a US citizen relative, marriage, an employer, asylum, or the lottery. The law (INA §244(f)(4)) says that while on TPS, for purposes of change of status, a person is considered to be in lawful nonimmigrant status. How this works in your specific case is for a lawyer to assess. Keep in mind the USCIS memo of 05/21/2026: adjustment of status is now reviewed more strictly.

✈️Can I leave the US with TPS and come back?+

Only with advance travel permission: you must file an I-131 and wait for approval before leaving.

  • Without permission you can lose TPS and not be able to return to the US, and if TPS is pending, USCIS may deny your application.
  • The base I-131 fee for travel on TPS: $580 online / $630 by mail.
  • Even with an approved permit, CBP may refuse entry. Right now, while the TPS end date is uncertain, lawyers advise not traveling without a consultation.
✅What should I do now, while there is no final TPS decision? A practical checklist+
  1. Keep copies: I-797 (TPS receipts and approvals), EAD, USCIS extension letters through 10/19/2026, I-94, passport.
  2. Print or save the USCIS notice of 10/19/2026 that protection and work authorization continue.
  3. Check myUSCIS: is the EAD extension letter there and is your address correct.
  4. Adults (18+): carry your registration document with you: I-94 or EAD.
  5. Talk to HR: show the USCIS notice and ask them not to take hasty steps before new instructions.
  6. Check the USCIS Ukraine TPS page and the Federal Register regularly.
  7. If you have another path (re-parole, family petition), make sure it moves forward in parallel.
  8. Do not plan trips abroad.
  9. If you have had arrests, denials or a removal case, do not delay a consultation with a licensed immigration attorney or accredited representative.

💡 Tips and common mistakes

✅ Do this

7
  • Subscribe to updates of the USCIS page on TPS for Ukraine and check the Federal Register once a day for the words "Ukraine Temporary Protected Status".
  • Print for your employer the USCIS notice of 10/19/2026 (protection and work authorization continue), the EAD extension letter through 10/19/2026 and the I-9 Central notice of 09/03/2026.
  • Create a myUSCIS account and link all your receipts to it: extension notices arrive there faster than by mail.
  • After 10/16/2026, check the fee amount on G-1055 before every payment: the old amount = a returned package.
  • Pay H.R.1 fees as a separate payment: they cannot be waived with I-912.
  • Keep another status or application going in parallel (re-parole, family petition) if you are eligible.
  • If you have grounds for an expedite (job loss, medical treatment), start collecting evidence now: an employer letter, medical documents.

⛔ Avoid this

7
  • Believing headlines like "TPS extended to 2027" without a document in the Federal Register or on uscis.gov.
  • Working "unofficially" if your employer took you off work because of the 10/19/2026 date on your EAD. Show the USCIS notice of 10/19/2026 and file an expedite request instead.
  • Leaving the US without an approved I-131: you can lose TPS and not be able to come back.
  • Filing a second I-821 "just in case" while the first one is still pending.
  • Sending an application postmarked on or after 10/16/2026 with the old fee amount.
  • Thinking children get TPS together with their parents: each child files their own I-821.
  • Not telling USCIS about a change of address (AR-11 within 10 days) and missing an important letter.
